These are the terms and conditions for use of the E-FWD Digital Hub by users (“Users”) found at www.efwd.energyvoice.com (the “Digital Hub”). Users are granted access to the Digital Hub by their employer or other entity that has purchased membership for Users (the “Member”) and is responsible for the actions of their Users actions under the Membership Terms and Conditions. The Digital Hub is owned and operated by DC Thomson & Company Limited (hereinafter referred to as “we” or “us”).
Please read these terms and conditions carefully before accessing the Digital Hub. Your use of the Digital Hub is governed by your relationship with the Member and these terms and conditions. If you do not comply with these terms and conditions then we or the Member may suspend or terminate your access to the Digital Hub.
These terms and conditions should be read in conjunction with our Membership Terms and Conditions, our Acceptable Use Policy and our Privacy Policy. Additional terms and conditions apply between the Member and us in respect of your use of the Digital Hub.
By continuing to use the Digital Hub, you acknowledge that you have read, understood and accept these terms and conditions.
1. Registration
You may access the Digital Hub if your company becomes a registered member of E-FWD and purchases a User subscription for your benefit. You, as the User, agree to be responsible for maintaining the confidentiality of your passwords or other account identifiers.
By registering on the Digital Hub, you agree that:
- your account and password are personal to you and may not be used by anyone else to access the Digital Hub;
- you will not do anything that would assist anyone who is not a registered user to gain access to any area of the Digital Hub or to access any content in the Digital Hub; and
- you will not create registration accounts for the purpose of abusing the functionality of the Digital Hub, or other users; nor will you seek to pass yourself off as another user.
You agree to notify us immediately if you become aware of any unauthorised use of your password or account identifiers by others.
Termination of registration
If you no longer accept these terms and conditions, or any future modification to these terms and conditions, you must stop using the Digital Hub. Continued use of the Digital Hub indicates your continued acceptance of these terms and conditions.
Where we are entitled to suspend or terminate your membership or access to any services or features of the membership, including your registration with the Digital Hub, we will use reasonable endeavours to notify your Member, and you by email sent to the email address set out in your member profile.
Use of material appearing on the Hub
Except for user generated content (as discussed below), we or our licensees are the sole owner of all content on the Digital Hub (including, without limitation, all applicable intellectual property rights), including the rights in any text, images, graphics, logos, audio, video, URLs, metadata and other material appearing on the Digital Hub (“E-FWD Content”).
Your use of the Digital Hub and E-FWD Content is for your own personal internal business use. You may download and print extracts from the Digital Hub for your own personal internal business use, provided you maintain and abide by any author attribution, copyright or trademark notice or restriction in any material that you download or print.
You shall not without our prior approval (and you shall not facilitate, authorise or permit any other person to):
- scrape, reproduce, copy, alter, collect and/or extract the E-FWD Content, , for text and data aggregation, analysis or mining purposes;
- use the Digital Hub and/or the E-FWD Content for any purposes not specifically authorised in these conditions; or
- otherwise use the Digital Hub and/or the E-FWD Content for any other purpose that is not expressly permitted by these terms.
We reserve all rights in the E-FWD Content.
No reliance
We are not responsible for the accuracy or availability of any E-FWD Content. We are not responsible to you for any loss, damage or cost resulting from any decisions that you make in reliance on any information contained in the Digital Hub or the E-FWD Content.
User Generated Content
Users of the Digital Hub may be permitted to interact with others on the Digital Hub, for example by posting comments, contributing to online discussions or participating in online networking events. Interactions within the Digital Hub are governed by our Acceptable Use Policy which are incorporated into these terms and conditions. If you choose to interact with others on the site by posting content or comments, you will be deemed to have accepted the Acceptable Use Policy.
You must only submit content to the Digital Hub that you have created or that you have permission to share on the Digital Hub.
By submitting content to the Digital Hub, you are granting us an irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide licence to use, publish, transmit, cut, crop, or edit your content in any format and in any media, either now known or hereafter invented.
You acknowledge and agree that you post your content at your own discretion and risk, including any reliance on the accuracy and completeness of the content. You further acknowledge and agree that the views expressed by you and other users in the content do not necessarily reflect the views of DC Thomson & Company Limited or its subsidiary companies, and we do not support or endorse any user generated content. You acknowledge that we have no obligation to pre-screen, monitor, review or edit content posted by users to the Digital Hub. We do not accept responsibility for the deletion or failure to store content or other information submitted by you to the Digital Hub due to technical error.
You acknowledge and agree that we may refuse or remove your content from the Digital Hub at any time at our sole discretion and without reason.
We accept no liability in respect of any user generated content on the Digital Hub.

Changes to these terms and conditions
We may amend these terms and conditions from time to time. Please check these terms regularly to ensure you understand the current terms that apply. Any revised terms are applicable at the time of posting. You will be deemed to have accepted a variation if you continue to use the Digital Hub after the date of the revised terms.
No waiver
Our failure to insist upon or enforce any provision of these terms and conditions shall not be construed as a waiver of any provision or right.
Governing law & jurisdiction
These terms and conditions are governed by Scots law and the parties agree to submit to the non-exclusive jurisdiction of the Scottish courts.
