BP has launched a new appeal over a ruling upholding the multibillion dollar compensation settlement for victims of the Gulf of Mexico spill four years ago.
The British oil major claims that a decision earlier this month by a divided three-judge panel to uphold the settlement was in error.
BP, which has paid out billions in compensation claims already, says the panel should not have upheld a ruling over a class action lawsuit by Judge Carl Barbier last year that did not define if the members had claims against the defendants.
It lodged an request to review the decision by the judges last night.
“If the panel’s decision is permitted to stand, it will work a revolution in class-action law in this Circuit, permitting the certification of classes that cannot be certified anywhere else in the country,” BP attorneys wrote.
In October last year, a different panel of judges dismissed Judge Barbier’s ruling over some business payouts and ordered him to change the damages calculation in some cases.
